These Terms of Service (“Terms”) govern your access to and use of the website i-am-agile.com (the “Website”) and any courses, content, services, or features offered by Agile Mastery Academy (“Agile Mastery Academy,” “we,” “us,” or “our”) (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

By using the Services, you represent and warrant that:

Assignment submissions, quiz answers, or feedback

(collectively, “User Content”).

By submitting User Content, you:

Grant Agile Mastery Academy a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your User Content solely for the purpose of operating and improving the Services.

Represent and warrant that you own or have the necessary permissions to submit the User Content and grant the above license.

Agree that your User Content will not infringe any third party’s rights or violate any laws.

We reserve the right, but are not obligated, to review, remove, or refuse any User Content that we believe violates these Terms or is otherwise objectionable.

7. Prohibited Conduct

Result in employment, promotion, or income; or

Guarantee passing any third-party certification exam, as these are controlled by their respective organizations.

10. Limitation of Liability

To the maximum extent permitted by law:

Agile Mastery Academy, its owners, instructors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Services.

Our total cumulative liability to you for any claim arising out of or relating to the Services or these Terms shall not exceed the greater of:

The amount you paid to us for the specific course or service in the three (3) months prior to the event giving rise to the claim, or

$100 USD (or equivalent in your local currency).

Some jurisdictions do not allow limitations of liability; in such cases, the above limitations may not fully apply to you, and our liability will be limited to the minimum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Agile Mastery Academy, its owners, instructors, employees, and partners from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Services;

Your violation of these Terms; or

Your infringement of any third-party rights.

12. Termination

We may, in our sole discretion, suspend or terminate your access to all or part of the Services at any time, with or without notice, including if we believe that:

You have violated these Terms;

Your conduct may cause harm to us, other users, or third parties; or

The continued provision of the Services is no longer commercially or legally viable.

Upon termination:

Your right to use the Services will immediately cease.

Any provisions of these Terms which by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law principles.

You agree that any disputes arising out of or relating to these Terms or the Services will be resolved in the courts located in British Columbia, Canada, and you consent to the exclusive jurisdiction of such courts.

Your continued use of the Services after any changes become effective constitutes your acceptance of the updated Terms.
